Case 1: Presented by Christopher L. Boldt, Esq.

Topic: You Need What from the ZBA? The Law on Appeals of Administrative Decisions, Special Exceptions, Variances and Equitable Waivers

Chris is a partner at Donahue, Tucker & Ciandella, PLLC in the Firm’s Meredith, NH offices, where he concentrates his practice on municipal and real estate/land use law. He earned his B.A. from Trinity University in 1984, a Diploma of Anglo-Irish Literature from Trinity College, Dublin in 1985, and his J.D. from the University of Texas School of Law in 1988. Chris actively handles matters involving municipal law and taxation, conveyance and title issues, boundary disputes, land use and development matters, and conservation easements throughout New Hampshire, matters before various State Agencies including the BTLA, PUC, DES and DOT, appeals to the New Hampshire Supreme Court, and mediation. Since February 2004, Chris has been appointed as a member of the NHBA Real Estate Section’s subcommittee in charge of reviewing and revising the New Hampshire Title Standards. Chris is a member of the Carroll and Belknap County Bar Associations, the Vermont Bar Association, the State Bar of Texas and the New Hampshire Bar Association. Chris is a frequent lecturer for the New Hampshire Municipal Association, the New Hampshire Office of Planning and Development, the New Hampshire Bar Association, and the New Hampshire Land Surveyors Association. Chris has served as a Selectman, Planning Board member and Library Trustee in his adopted hometown of Sandwich, NH.

Case #2: Presented by Brett Allard, Esq.

Topic: 2025 Updates in the Law

This presentation will be a combination of recent Supreme Court cases and new legislation impacting real estate and land use law. In that regard, there has been quite a bit of activity over the last few months, so this should be fresh content for everyone.

Brett focuses his practice on real estate and land use law. He advises clients in all aspects of land planning, zoning, and real estate development matters, helping them navigate through the maze of local, state, and federal permitting. He is well-versed in handling all types of development projects, from basic lot line adjustments to large complex residential subdivisions, commercial projects, mixed use planned unit developments, and roadway issues. Brett previously worked with the New Hampshire Department of Environmental Services Wetlands Bureau and has extensive experience of representing clients in both residential and commercial lakefront and shoreland development projects. He frequently represents clients before local zoning boards, planning boards, and other municipal bodies in connection with real estate development matters.

Brett also assists clients in real estate litigation cases, landlord tenant matters, and residential and commercial transactions, including acquisitions, dispositions, leasing, and financing. Brett graduated from the University of New Hampshire School of Law as a member of its highly acclaimed Daniel Webster Scholar Honors Program. When Brett isn’t working, he enjoys spending his free time playing golf, hockey, snowboarding, and traveling.

Case #3: Presented by Loralie Gerard, LLS #883

Topic: Physical Evidence, Parol Evidence, Common Shoreline terms, and “WHO’s” footsteps?

In 2013, she conducted a boundary survey on a parcel of land (camp lot) located along the shores of Merrymeeting Lake in New Durham, NH. Her client and their abutter’s boundary survey were in conflict. Both property owners retained counsel, and it took two years to come to an agreeable resolution.

Loralie is the Director of Land Surveying for Bergeron Technical Services practicing in Conway, New Hampshire, offering all aspects of Land Surveying Services including but not limited to Land Use Analyses, Permitting and NH Septic System Designs. Ms. Gerard received her associate’s degree in Forest Technology/Land Surveying from Paul Smiths College in 1982 (New York) and completed several Soil Science courses within the University of New Hampshire system. Ms. Gerard has been a licensed land surveyor for over 26 years in New Hampshire, a professional licensed land surveyor in the State of Maine since 2017, and a NH Designer of Subsurface Disposal Systems since 1985. Ms. Gerard has been the New Hampshire Land Surveyors Association Educational Director since 2023.

Chairlift rides: Presented by Luke Powell

Topic: Soils, Wetlands, and Vegetation in Alpine Zones

This presentation will take us on a 15-minute chairlift ride to the summit at Gunstock where Luke will review soil conditions in frigid climates.

Luke started Powell Asset Mapping, LLC after retiring as Assistant Director of Public Works for the City of Laconia, NH. His career spans over 40 years in both the private and public sectors engaged in the disciplines of forest management, wetlands and soils mapping, survey and engineering technical work, and municipal public works management. Powell Asset Mapping, LLC focuses on wetland delineations and associated wetland and shoreland permitting, site specific soils mapping, and building simple geo-referenced databases and maps for stormwater and sanitary sewer systems utilizing GIS software.
